Implicaciones anticompetitivas en la legislación paraguaya de hidrocarburos: análisis crítico y multidimensional

Este estudio examina las implicaciones anticompetitivas del Artículo 5° de la Ley N° 779/1995 de Hidrocarburos de Paraguay. Mediante un análisis multidisciplinario que abarca perspectivas jurídicas, económicas y de política pública, se evalúa cómo la disposición sobre expropiación puede restringir la competencia sin justificación suficiente. El estudio revela que la norma no cumple con los principios de necesidad, proporcionalidad y no discriminación, pudiendo generar distorsiones significativas en el mercado. Se proponen recomendaciones para reformar la legislación, promoviendo un entorno más competitivo en el sector de hidrocarburos paraguayo.
