Anti-competitive implications of Paraguay’s hydrocarbons legislation: a critical and multidimensional analysis

This study examines the anti-competitive implications of Article 5 of Paraguay's Hydrocarbons Law No. 779/1995. Through a multidisciplinary analysis encompassing legal, economic and public policy perspectives, it assesses how the expropriation provision may restrict competition without sufficient justification. The study reveals that the regulation does not comply with the principles of necessity, proportionality and non-discrimination, and may generate significant market distortions. Recommendations are proposed to reform the legislation, promoting a more competitive environment in the Paraguayan hydrocarbons sector.
